The strength of your personal injury case depends on a number of factors, including the severity of your injuries, the total amount of your medical bills, the negligence of the other party, and the evidence available. Call 911 and report the accident to the police. If you are able to get out of your vehicle, the first thing you should do is take a picture of the license plates of the other vehicles. Next, take pictures of any property damage to the vehicles, including close-ups of the damage and pictures taken from far enough back to see the entire side of the car where it was damaged.
The police usually provide a driver’s exchange of information form at the accident scene. This document lists the other drivers and their addresses and usually their insurance company. If you are not given a driver’s exchange of information at the accident scene, try to get the other drivers to let you take pictures of their insurance card and driver’s license or ask them to provide you their name, address, phone number, insurance company name and policy number. This is all information your attorney will need.
Always keep a working pen handy. It's a good idea to keep a small notepad in your glove box, too, to record the name, phone number, and insurance information of the other drivers involved in the accident. Be sure to keep a copy of your current insurance card in your glove box, and the best place to put it is in the envelope that holds your vehicle registration. Additionally ,it's always smart to have a small flashlight in your car in case it's dark outside at the time of the accident.
You should still do the things listed in the answer to "What should I do immediately after a car accident?" An accident generally causes your adrenaline to increase, and often people do not feel pain or injury from an accident while at the scene. However, people often feel pain or injury hours or days after the accident when they have calmed.
That doesn’t matter. Florida requires all automobile owners to carry personal injury protection (“PIP”) insurance, which is sometimes called “No Fault” insurance. At a minimum, your PIP insurance pays 80% of your medical bills after a car accident up to $10,000.00 and might pay more depending on the coverage you purchased. The purpose behind PIP insurance is to allow people injured in car accidents to get medical treatment right away without having to wait for the at-fault person’s insurance company to accept responsibility for their insured’s negligence. If you do have health insurance, your PIP insurance serves as your primary insurance and should be provided to the emergency room, urgent care, or other medical provider who provides medical treatment.
No, it does not. In Florida, you must seek medical treatment of some kind within 14 days of the auto accident, whether it be an emergency room, urgent care center, medical doctor, or chiropractor, in order for your PIP insurance be required to pay for the treatment of your injuries. If you do not receive some type of medical treatment within 14 days of an automobile accident, your PIP insurance company will not pay any of your medical bills.
